I liked my salesman, Thomas G. Mack, and left his card out to recommend Cable to my tenants when they move into my rental properties, but he stopped by shortly after selling me Optimum services to tell me he has been re-assigned.

 

Other than the salesman my changing to Cablevision from Direct TV has been a disaster. I was told by a representative it would be easy to “port” my telephone number to my new Optimum account.  Nothing could have been further from the truth, and I was never told I would be charged $40 for the fiasco. 

 

The first of five appointments to have a technician come to port the number was cancelled by you hours before the technician arrived.  He pulled into my driveway for a minute or so, and left without entering.  A few minutes after he left we noticed all our Cablevision services had been shut off.  It took over an hour on the phone before anyone would believe me that your technician shut off my cable, and six more hours before service was restored.

 

Now you send me a bill that you say I need to pay or service will be shut off.  You will note that I have called customer service no less than five times, navigated your difficult phone services each time to speak to people, noted their names and times of calls, and was assured by each that my call was recorded in their notes.

 

  I have been told variously that the bill will be adjusted, to wait for final bills, that the bills have been adjusted to reflect changes, to not pay the bill because it is wrong, and finally that the bill is correct and to pay it immediately.  Each time I followed the logic of your customer service workers, and in this final case I paid the bill.

 

Now, surprise, I have received a shut-off notice.  Please call or write or fax me to confirm that my service will not be shut off because I have paid the “overdue” $33.46 that Terry at customer service told me not to pay because it was wrong, but later Kimberly said I should pay, and I did pay with a check 4186 on April 4.  

Since you are still sending shut-off notices I need confirmation that you have received the check.

 

I will call you in a week anyway because, although I was promised by my salesman and several customer service workers that you would pay my early termination fees from Direct TV (a company which worked quite well for my for almost two years, by the way) you did not tell me that in order to qualify for such payment I needed to give a copy of my bill to my salesman, another copy to the installation worker who installed the Optimum Services, send another by mail, and then I needed to send a copy final bill showing zero balance after I pay it.

 

 

 

 

 

I am not done yet.  Then, Kimberly from Customer Services explains, I must be approved for the payment promised so many times requiring so much verification, which takes about a week.  And I will not be notified if I am not approved.  I need to call to find out, in about a week.  

 

Ironically every time I call I am told that such information might be available on your web sites.  Obviously if such information were readily available I would not have bought your services.  So when I call next week, navigate your phone system, I will find out if I will be shut off, and if you have received my check as well as if I am approved for your payment of my termination fees from your competitor.

 

Finally, I need to wait six to twelve weeks for reimbursement check.

 

For your information, a copy of this letter, and your reply (in the unlikely event you should reply as I am clearly requesting a reply) will be posted on my AgainstGoliath.com web site.

Undocumented Immigration

The 14th Amendment was written to define who are citizens and affirm that all citizens receive “equal protection under the law” and benefits from the government. It was written just after the civil war when it was still not clear if black people were citizens and if the government would treat them differently from white people.

Now there is confusion about who gets government services because there are just so many in the US who are not citizens. Those here without papers, undocumented, or “illegal” either are or are not entitled to “equal protection under the law” and that is the problem.

Obviously an “illegal” would be someone who has broken a law. But many people who do not have papers may not have broken any laws, and according to the Constitution no one must incriminate oneself by showing or explaining what they may or may not have done which breaks a law.

So undocumented people, and there are as many as 20 millions, (equivalent to the entire population of five or six of our smaller states) are certainly not entitled to any benefits from the government, no one asserts they are, but some of us believe they are entitled to equal protection under the law. That is a big question.

For example, if an undocumented resident is robbed or wins the lottery or buys property can the government just say you are on your own? And if the government does not help enforce contracts with undocumented residents, and the undocumented community enforces such contractson their own through different means, such as a parallel legal system, a neighborhood watch or social activism, is that legal?

In any case these people are not leaving voluntarily. It is a problem the Federal Government will deal with one day. Many undocumented residents have been here for decades, their children are citizens or at least have graduated our schools and feel as American as you and I.

This problem will not go away. We cannot just shoot them or march them to Mexico. And Congress is useless. I suggest we fine them, make them pay like $20k to stay, but I am not in Congress so no one listens to me.

Morality and the law – Why Microsoft has no soul.

Microsoft accused me of copyright violation and piracy.  Did they know I wasn’t guilty?  They certainly knew they had no evidence I had done anything wrong.

Probably they are just disorganized and stupid like every other organization.  Some 15 people just didn’t get their act together and I got accused.  It took a year to straighten out the mess, and cost Microsoft big bucks for Perkins Coie lawyers, air fair and lots of incidentals.

Somebody in Torrington complained to Microsoft about me.  I had been in business for 15 years, have 5000 customers, and, according to Microsoft they had received three complaints.  But this one made them send me a form letter.

Patricia Urban got a list from some list-keeper at Microsoft that said I had received the form letter.  That was her green light to try to trap me into selling her some pirated Microsoft software.  I don’t know if she thought up the plan by herself, or if it developed over time, but she asked me to sell her Microsoft products that Microsoft no longer sold.  I sold her I the products she wanted from eBay which Microsoft’s Sue Ventura assures us was pirated.

Urban gets pirated software from me and tells probably Sharon Cates that I sold pirated software and that is all she needs to know.  She calls Perkins Coie who puts Katherine Dugdale on the case to prosecute this pirate you are reading right here right now.

Who is morally reprehensible?  Certainly Patricia Urban, and Sharon Cates, and Katherine Dugdale.  None of them bothered to consider what they were doing.  The law allows them to prosecute people for $150,000 for downloading a single pirated song, but in this case they just assumed I was scum because Patricia Urban bought a computer from me.

I am absolutely certain Cates had no idea what was going on.  Microsoft was flying blind.  Dugdale might have known, might have done her job, might have read the case notes and seen that there was no evidence against me.  She might have continued the case because it is all just billable hours to her and her company, and who know?  They might just find something bad about me in the Discovery process.

At some point she wanted out.  She got a subservient young John K. Roche to take her place, to take the blame for her as things started going badly for Microsoft.  And he saw the problems as well, and somehow got out of coming to the final settlement conference.  He sent me some friendly email asking me for a confidentiality agreement that just said I would not say anything bad about Microsoft.  In the settlement conference Judge Martinez said there is a fine line between not saying anything bad and not saying the truth.  But in any case our settlement agreement does not keep me from saying anything bad about Microsoft, which is in the final analysis a bad company.

We should also say something about the Connecticut firm which filed the charges against me in Federal Court for Perkins-Coie.  That is the Connecticut flunky firm Roche-Pia LLC.  They had no hand in this whatsoever.  They only wanted the billable hours, and the both of them knew they would get money for very little work and no one knew or cared whether or not I was a pirate.  It did not matter.  They just wanted the money.

You might ask how I know who is a flunky, who is important, and how I knew.  John K. Roche is the first to walk up to me and say how lucky I was that I have this Microsoft representative and not another, because the other is much harder. And Gerald Pia did the same thing at the second settlement conference.  Further, Pia was actually carrying the umbrellas of the Microsoft delegation.

So the only person to come out of this mess with integrity was me.  Dugdale hoped I would be scum but couldn’t prove it, and was just trying to make money for her firm.  Roche – Pia were both just money grubbers, didn’t know or care about anything.  They just had to sign their names, spring for postage and show up for court.

Sharon Cates was the only Microsoft employee involved, and the big wig that came to court.  I wish I had his name.  I don’t know even if it was the same man who came both times.  Somehow I will find his name, but it was not in any court documents.  Both of those who actually worked for Microsoft acted shamefully.  They did not know or care about the details, they just wanted money from me.  Cates said horrible things about me that were not true.  The guy in court just didn’t know what was going on.

Reduce Oil Consumption???

Okay, everyone buy a Chevy Volt even though it costs twice what a comparable gas powered car costs and has half the expecteed life cycle.  Do it to help President Obama reduce the amount of gas we import.

Or we could change the laws.  Yeah, we have a shot (this is sarcasm).  In Mexico they have a Hyundai http://en.wikipedia.org/wiki/Hyundai_Atos  that gets 44 MPG and costs less than $6000.  In India they have a car that looks like a Smart Car and costs under $3000 and get 66 MPG.  Do you think we could get either car here?  If so, you are deluded.  If you want to get 40 MPG in the United States you need to spend over $40,000.

Why?  Because of the DEP.  We have laws that do not look at how much pollutants are produced by a motor vehicle (that would make sense) but rather what percentage of the entire exhaust is pollutant.  That means we need larger motor sizes to run all the emmisssions controls in order to put out, overall, more pollutants than a smaller engine, but a lesser percentage of the total exhaust.

Why?  Because it is complicated and they got away with it.  Is Congress going to change anything?  Our Congress?

So, no, we will not get a cheaper car, only a more expensive car.  Is that good for the environment?  Good for the economy?  Neither, but it is the law.

Microsoft’s Predatory Litigation listing

This link Microsoft provides claims they have earned $40 million from pirates like me, and recouped $200 million in pirated products.

But every case I have investigated is sealed with confidentiality.  The only reliable information is the case number.  Other than that no one is talking.

 I doubt any of these people are guilty of breaking any law at all. I know I didn’t.  But I am the only one who did not sign a confidentiality agreement.   Probably most of them just told their insurance companies to pay Microsoft off to shut them up and keep their reputations.  No one understands Copyright Law, so if you are accused of “piracy” it is very difficult to prove you are not a pirate.

Microsoft depends upon intimidation and everyone just assuming Microsoft wouldn’t lie.  But they lied every chance they got in my case.  Anyone wanting examples can read the book.   I am the only one who did not agree to keep my mouth shut, and in my case Microsoft acted like a monster. 

In case they they pull it, here is a downloaded copy of the information at Microsoft’s link above.  There is nothing there anyway except case numbers, names and dates.  I doubt any of it is true, but with total confidentiality there is no way to find out.

Microsoft attacks again

I too am suspicious of Microsoft’s motivations, as their lawyers are still at it, having served a summons similar to yours to Proton Computers in Lombard, IL; a company with whom I’ve done business professionally for 8 years.  I have no ownership interest in Proton, but I consider them a valuable partner in providing solutions to my clients.  As such, before I found your site, I was working on a ‘friend of the court’ brief (copy attached).  I would appreciate your comments and input.

Along with Proton, another (larger) store got sued also, probably with the same vague accusations with no details of proof.  Unlike you, however, Proton has not been trashed in the local press.  I do hope you got some favorable press at the end.
 

I believe what’s at risk here are tens of thousands of American technical jobs (those who do the refurbishing of older computers) versus tens of thousands of Chinese jobs (those would build new computers).  I believe Microsoft’s Refurbisher Program doubly adds to the cost of a used computer, 1) the $35 second license fee paid to Microsoft, and 2) in the extra labor time it takes to refurbish in compliance with Microsoft’s rules.  These combine to raise the cost of a used computer to be unaffordable compared to a new one.  

 

I believe Microsoft’s rules are not in the best interest of the people of the United States.  When Microsoft ceases support for XP and withdraws XP from its Refurbisher program, there will be no legal way for small refurbishers to obtain kits, dooming millions of computers to the landfill (even after electronics recycling there’s still a crushed carcass to deal with).  Microsoft doesn’t care, as they’ll collect the license fees on new computers people of all incomes will be forced into paying.  For many, this means having to purchase a cheaper computer which won’t last as long.

More about laws…

Having just spent a week in Cancun highlights all the differences in politics between countries.  From an American perspective there are hardly any laws in Mexico.  Apparently Mexicans hardly think about the difference, but there are signs of change.  I certainly don’t understand Mexican politics, but I have visited the country in the past, see things as they are from television and newspapers, and notice some changes.

Decades ago there were no government services in Mexico to speak of.  The country did not trust the government, did not care.  And that was fine with the government as well.  Police made almost no money from their salary and made their living levying fines on those they deemed offenders of the laws.  The process worked that way all the way up the food chain, it was just the system. Taxes were levied whenever money changed hands, 5% of the gross.  The government levied the tax wherever and whenever it could, and the people avoided paying it the same way.

There was no industry to speak of except in the big cities, but the weather was always good and people did not starve due to their own agriculture and micro economics in the villages.  The federal government was hated and avoided whenever possible.  This made the country ripe for growing and exporting drugs to the United States.  The people in general, however, did not use or approve of drugs.  But grassroots organizations in isolated areas began to export and spread the wealth around.  The people hated the government but began improving their lot in life through exports.

In many cases drug cartels were indistinguishable from aid organizations and other agricultural enterprises.  They were employers, but they avoided the government with more vitality than other employers.    Security was necessary but the money was good, and the government was resisted by paying it off and/ or direct rebellion.  Many popular uprisings were characterized by media and governmental institutions as drug wars.

The money came from the United States, and politics on this side of the border put the burden on Mexico to stop the export instead of trying to stop import.  The US sent money and people since the beginning of the DEA to Mexico to stop the cultivation and export of drugs when the only reason for its cultivation was because of the large market for those drugs in the US.  That money was often the impetus for squashing popular uprisings in isolated villages with great forces.  The Mexican government was blamed and the people hated the government more and more for the misery it was bringing them.

This trip, however, I see ads on TV, billboards and newspaper articles telling people what the Federal government is doing for them.  Mainly it is in public access to the beaches (federal property in Mexico) and high speed roadways but it is a start.  Just look at all the Federal services we get in the US.  Transportation, education, health, labor…  The number of people who get a monthly federal check is enormous.  And we are paying the consequences, which brings us back to the beginning of this article.  There are too many laws in the US for us to support with taxes. 

I hope Mexico does a few things with federal dollars to help itself to develop.  No country should scrimp on spending for the education of its youth.  And any country that can stop or slow corruption of its government will see immediate benefits to its people.  I have suggestions there, but no good advice.  Scape-goating many officials seems the only way to start such an enormous endeavor, but it must be coupled with fair pay for government employees.

Too Many Laws

To the editor of the Register Citizen.

I have been looking for a simple way to explain what is wrong with America for a long time and today’s news in the Torrington Register Citizen shows it simply. We have too many laws, too many politicians, too many lawyers, and too many prisoners. The taxpayer just can’t pay for it all.

Innocent children, as many as 2 million of them nationwide, were brought to this country by cars and trains and boats and planes, and their parents decided to put them in the school system. Because of that decision as many as 35 years ago, and a complicated and seriously broken set of laws, our government has decided to begin deporting them. These people have broken no laws. There is no law against “being” in America. But they are deportable and they have NO CHANCE of ever being “legal” in the only country they have ever known. Does anyone think there will be any change any time soon?

And then there is a guy who began fixing cars in a garage without getting, what, seven or eight permits and licenses? How long should he go to jail?

As a business owner in Torrington I know it is practically impossible to do anything according to the law. So I don’t. I continue what I have been doing for years and not start anything new because, hey, I could go to jail, or go bankrupt trying to avoid breaking way too many laws.

Only government employees and lawyers benefit from these laws. Well, there are also those businesses licensed by government employees to do work and thereby have a government sanctioned monopoly on all work and charge more to pay the taxes, permits, lawyers, professionals and government inspectors. These are the businesses that hire lobbyists and contribute to campaigns so that they can keep their monopolies. Just ask the guy who wanted to repair cars in his garage. Or Microsoft, who sued me for $2 million dollars and lost.

My industry is not yet licensed, but when it is I will have to charge a lot more for my services. In China they can build a skyscraper or a bridge in a year. In the US we are lucky to break ground in five years or finish in a decade. Watch the US become regulated into bankruptcy and largely unregulated Latin America increase their quality of life because they have newer infrastructure and more productive manufacturing.

The US Congress costs us about a million dollars per congress person per year in salary and benefits paid to each of more than 500 of them. That is over $5 billion (with a B) a year. And they get nothing done. Would we be better off with more politicians? Will we ever have fewer politicians?

I’m just saying there are too many laws, and too many politicians, and too many lawyers, and too many government employees, and too many prisoners, and too many illegal immigrants, and no way to change any of it or pay for it all. If our government were a business it would be time to cut out some overhead. The only people to benefit from our system are the politicians and lawyers and government employees, and the monopolies they created.

Just my job

Mitt Romney paid his taxes.  You can’t blame someone for paying their taxes as the law proscribes.   If one is in the %15 tax bracket first there are a lot of deductions to arrive at the Adjusted Gross Income which is, well, adjusted.  Then you pay your taxes.  And if you make $50 or $50 million in the  year you pay your taxes according to tax rules for you.  If you drive a car you put on your seat belt and drive under the speed limit following the laws.  If you do these things you are within the law and no one should have any problem with you following the laws.  If you qualify for welfare, you can receive welfare.  If you qualify for Social Security, WIC, HUD, government loans, whatever, no one should have a problem with that.

If, however, you don’t like the laws, well, then you have a problem with our government, not with the people who are following the laws you don’t like.  In my opinion we should all have a problem with our government.  Our government wants complicated, stupid laws to support lawyers, politicians, and government employees.

In my case, the Microsoft suit against me wasted lots of community resources, lots of tax pay money, for nothing.  People make their living following the rules of our government, following the law, and extorting money from people like me who never did anything wrong.  Perkin Coie LLC lawyers, on behalf of Microsoft, tried every trick they could to circumvent justice and gain a win at my expense.  They tried everything short of showing I broke a law  in order to get me to pay them.  The tricks they used were all legal, and in my case Magistrate Judge Donna F. Martinez did not fall for those tricks.  I was lucky in that regard.

Judges do not have to be fair.  It is not in the job description.  But if there is any fairness in the system that fairness will come from the judge.  There is no fairness in the proceedures, only the possibility of fairness.  They have to be impartial, they do not have to be fair.

So do we blame a lawyer who has no proof I did anything illegal, but prosecutes me?  Do we credit the judge who, after listening to nonsense for a year and allowing hundreds of stupid pages of disputes and explanations and arguments to be filed, guides a settlement?  The lawyers and the judge make their living like that.  I am defending my business, my livelihood, from predatory litigation.

And the main tool the predators have is confidentiality and the law.  They are allowed to seek confidentiality and they are allowed to follow stupid, confusing, arcane and skewed laws.  No one has to listen to them but the judge.  And the judge makes a living listening to this stuff and does not want to alienate that livelihood by actually making sense until the end.  Log in the hours listening, then make sure both sides get thrown a bone so they will come back.

I just argued a case in Connecticut small claims.  Me versus Dr. Patrick Pollak, DMD of Aesthetic Family Dentistry on 454 Prospect Street, Torrington.  As I argued small claims several times before, probably with the same judge.  This judge is anonymous.  He had no name. I asked him and he did not answer.  He said that we have no recourse if we don’t agree with his judgement.  There is no appeal, and he can assure us that neither of us will be happy with his decision.  I do not know how he decided or will decide, he will mail us his response.  In my opinion Patrick negotiated a service I performed on his computer, agreed on the price, wrote me a check, then stopped payment on the check.  Patrick said I charged too much and kept changing my price. I honestly don’t know what the judge heard and what he thinks is complicated about it.

Almost daily, but at least weekly, I run across incompetent workers, strange problems.  I bought a product from China that I received broken in the mail.  It was very cheap, and I told the vendor of the problem and they asked for a picture of the broken item.  They sent me two of a completely unrelated item.  I told them and they asked for a picture.  I said I already sent one, but here is another.  So they sent me a refund.  Go figure.

Here is a rough transcript of me giving an ATT employee hell for incompetence:

Mrs. Hitchens, ATT on the phone:  But I don’t feel like I am incompetent.

K (looking at paper): Do you remember telling me you were writing down the first harassing call I marked was Sept 14 at 3:38 PM, and that I need to make a police report so that I can see who the calls are from?

H: Yes, but I didn’t know that there was a five day limit….

K: What is your job title?

H: Executive Aid.

K: Had I gotten the police report as you directed me two days ago that information would have been useless, now, according to what you tell me today, unless and until I file Federal Civil charges against ATT and get a subpoena to find out if you are in fact indirectly responsible for the harassing calls I have been receiving for months.

H: Civil Charges?

K: I have no other alternative, Ms. Hitchens, according to what you say now, but focus.  ATT was wrong to charge me, was wrong to not send me a bill, was wrong to turn the account over to collections, and you were wrong to tell me to make a police report.  You are a bad part of a bad team, from my experience with you.

H: I can see why you say that Mr. Johnson, but I am trying to help you.

K: How?

H:  I can assure you the calls from NCO Financial will stop soon, and you will receive a letter from us…

K:  But you say there will be no specific information in the letter, no apology, no recourse, no assurances this won’t happen again to others except by my berating you here and now perhaps you will remember not to tell your customers to file a police report when your flunkies at NCO financial are harassing them…

H: I didn’t know that, and it is our policy to send letters before turning accounts over to collections….

K:  But to quote you: What good would it do now to go back over that?   …

Mrs. Hitchens was just doing her job.  Microsoft hired Katherine Dugdale of Perkins Coie to prosecute me and she was just doing her job.  Presidential Campaign Mitt Romney paid 15% taxes on his AGI.  None of them have any blame.  None of them considered fairness because, well, fairness is not their job. The system makes no sense, the system has the blame.
